Lex Mercatoria play a crucial role in resolving disputes arising from international trade contracts before arbitration bodies, thus establishing them as an independent legal system capable of regulating international commercial relations. This legal characteristic imposes a certain obligation on various arbitration bodies to apply them to the disputes brought before them, either based on the parties' intentions or based on the legal force inherent in those customs. Consequently, this research examines the extent of recognition of the binding force of commercial (...) customs before arbitration bodies, and based on that, it elucidates the authority of these bodies in applying them to international trade disputes. It is evident that these customs, due to their flexibility derived from the nature of commercial transactions and the customary practices of traders resorting to them, have become today an independent legal system that imposes itself on arbitration bodies even if the parties did not choose to apply those customs. This paper recommends the Jordanian legislator to explicitly adopt the application of these commercial customs in the Jordanian Arbitration Law texts, following the example of national and international comparative legislation. This study dealt with one of the most important legal subjects in private international law that relates to the topic of law applicable to electronic signature and is problematic by the lack of clear and explicit texts to determine the law required on the topic The main objective of the study was to reflect the legal regulation in private international law of such a problem, as well as to address some practical and applicable problems relating to the topic of the (...) study, including the legal nature of an electronic signature, When preparing this study, the researcher relied on the inductive approach by extracting legal texts on the subject of the letter in accordance with Jordanian legislation. in addition to the analytical approach where the researcher analysed and described the legislative and doctrinal positions and international conventions associated with the subject matter of the letter, The prescriptive approach, through a statement of the legal nature of the electronic signature. The researcher produced a series of results, the most important of which was the absence of clear and explicit texts specifying the law applicable to the electronic signature. This result was reflected in the recommendations of this letter, which were the most important recommendation to the Jordanian legislature that legal rules should be drawn up to determine the law applicable to the subject matter of the study. We show in this paper that the AGM postulates are too weak to ensure the rational preservation of conditional beliefs during belief revision, thus permitting improper responses to sequences of observations. We remedy this weakness by proposing four additional postulates, which are sound relative to a qualitative version of probabilistic conditioning. Contrary to the AGM framework, the proposed postulates characterize belief revision as a process which may depend on elements of an epistemic state that are not necessarily captured by a (...) belief set. We also show that a simple modification to the AGM framework can allow belief revision to be a function of epistemic states. We establish a model-based representation theorem which characterizes the proposed postulates and constrains, in turn, the way in which entrenchment orderings may be transformed under iterated belief revision. Given that health systems research involves different aims, approaches, and methodologies as compared to more traditional clinical trials, the ethical issues present in HSR may be unique or particularly nuanced. This article outlines eight pertinent ethical issues that are particularly salient in HSR and argues that the ethical review process should be better tailored to ensure more efficient and appropriate oversight of HSR with adequate human protections, especially in low- and middle-income countries. The eight ethical areas we discuss include the (...) nature of intervention, types of research subjects, units of intervention and observation, informed consent, controls and comparisons, risk assessment, inclusion of vulnerable groups, and benefits of research. HSR involving human participants is necessary to ensure health systems strengthening and quality of care and to guide public policy intelligently. Health systems researchers must carefully define their intent and goals and openly clarify the values that may influence the premises and design of protocols. As new types of population-level research activities become more commonplace, it is critical that institutional review board and research ethics committee review processes evolve to evaluate these research protocols in ways that address the nuanced features of these studies. The Bozeman scale is the most famous scale of statistical stylistics, and is based on the study of the vocabulary used by the author, and the number of verbs and adjectives in the text. Based on this scale, the ratio of dividing the number of verbs by the number of adjectives indicates its literary or sci-entific style and rationality. Therefore, this study aims to answer the follow-ing questions: How accurate is the Bozeman equation in measuring the lit-erary texts and the (...) emotionality of their authors? How does the style of a sermon differ from the style used in other literary arts? Do the subject and content of the sermon play a role in raising the level of the literary style and emotionality of the preacher? What factors affect the value of the Bozeman scale in political speeches and preaching sermons? What factors affect the value of the Bozeman scale in political speeches and preaching sermons? This study aims to apply this objective scale to sermons and compare the value of the scale in them with the percentages in other literary genres on which similar studies were conducted, such as poetry and letters. It also focuses on the impact of the content of the text on the value of the scale by comparing political speeches and preaching speeches. The study chose a sample of political speeches by Ziyâd b. Ebîh and Al-Hajjaj bin Yusuf Al-Thaqafi, and a sample of preaching sermons by `Omar bin Abdul Aziz and Al-Hassan Al-Basri, adopting the descriptive statistical analytical approach. The results revealed that the style of sermons is the most literary and emo-tional one among all other literary genres. Besides, preaching sermons sur-pass political speeches based on the value of the Bozeman scale, thus imply-ing that their style employs emotion, conscience, and literary images. In con-trast, political speeches are characterized by a rational style that relies on arguments and proofs. (shrink)

We address in this paper the problem of counting the models of a propositional theory under incremental changes to its literals. Specifcally, we show that if a propositional theory Δ is in a special form that we call smooth, deterministic, decomposable negation normal form, then for any consistent set of literals S, we can simultaneously count the models of Δ ∪ S and the models of every theory Δ ∪ T where T results from adding, removing or flipping a literal (...) in S. We present two results relating to the time and space complexity of compiling propositional theories into sd-DNNF. First, we show that if a conjunctive normal form has a bounded treewidth, then it can be compiled into an sd-DNNF in time and space which are linear in its size. Second, we show that sd-DNNF is a strictly more space efficient representation than Free Binary Decision Diagrams. Finally, we discuss some applications of the counting results to truth maintenance systems, belief revision, and model-based diagnosis. (shrink)

ABSTRACT In recent years there has been intense debate regarding the level of medical care provided to ‘standard care’ control groups in clinical trials in developing countries, particularly when the research sponsors come from wealthier countries. The debate revolves around the issue of how to define a standard of medical care in a country in which many people are not receiving the best methods of medical care available in other settings. In this paper, we argue that additional dimensions of the (...) standard of care have been hitherto neglected, namely, the structure and efficiency of the national health system. The health system affects locally available medical care in two important ways: first, the system may be structured to provide different levels of care at different sites with referral mechanisms to direct patients to the appropriate level of care. Second, inefficiencies in this system may influence what care is available in a particular locale. As a result of these two factors locally available care cannot be equated with a national ‘standard’. A reasonable approach is to define the national standard of care as the level of care that ought to be delivered under conditions of appropriate and efficient referral in a national system. This standard is the minimum level of care that ought to be provided to a control group. There may be additional moral arguments for higher levels of care in some circumstances. This health system analysis may be helpful to researchers and ethics committees in designing and reviewing research involving standard care control groups in developing country research. (shrink)

This study investigates whether financial performance is affected by corporate violations of laws and regulations. In a sample of 128 publicly traded banks that were subject to enforcement actions by US regulatory authorities over a 20-year period, we observed a significant negative market reaction pursuant to the violations. However, the market reaction did not vary meaningfully in accordance with the severity or repetitiveness of the violation. The results of this study are in conformity with previous research on industries other than (...) banking, notably with regard to negative market reaction. This confirms that shareholders in the banking industry react in a manner considerably similar to their counterparts in other industries. (shrink)

Some of the works written on the i’jaaz as an independent research field are pioneers in that they are among the firsts. Two of them belong to Hattâbî and Rummânî. In Arabic, there are many closely related words that are in a pattern with each other. Choosing the most appropriate of these words according to the addressee and context is an important criterion that determines the quality of the literature. This virtue is at the miracle level in the Quran. Hattâbî (...) and Rummâni examined the words of the Quran in terms of the literary virtue in question. Hattâbî did not stay within the framework of a particular literary art, but researched his word preferences in general and made comments about why that word was used in the Quran among other words with similar meaning. The spread of Islam to a wide geography in a short time had an effect on the activities of notification and invitation rather than military success. While Muslims invite communities that have not yet converted to Islam, on the other hand, they have taken care to keep the Muslim community alive with sermons and guidance by not neglecting their own internal reforms. They encouraged people who are well-equipped in terms of religious knowledge and inclined to oratory to bring religious love (...) and enthusiasm to the new generations, especially to the new generations. This sermon expectation of society has encouraged the growth of powerful preachers throughout history in the Islamic community. One of the factors that make the sermon effective is the reinforcement of the speech content with the literary language. Human nature, which is inclined towards beauty by nature, values the word being spoken by considering aesthetic concerns. The way to make speeches that are concise in words, deep in meaning, declaratively clear and intelligible depends on the proper use of literary arts. Literary writers try to make the most of the possibilities of literature and make their works permanent. In this study, the work al-Mudhish of Ibn al-Jawzī, who is one of the preachers who made his sermons effective by taking advantage of the rich possibilities of Arabic literature, was examined within the framework of the relationship between literature and preaching. The prominent literary elements in the work were examined in titles, striking examples were selected and critiqued. As a result, it has been revealed what Ibn al-Jawzī’s bringing together his sermon language and his literary work has brought to the sermon text. (shrink)

Several protective cellular mechanisms protect against the accumulation of reactive oxygen species (ROS) and the concomitant oxidative stress. Therefore, any reduction in glucose or fatty acid flux into cells leading to a decrease in the production of reducing equivalents would also lead to a decreased ROS production and protect cells against oxidative stress. In the presence of insulin, FOXO proteins are localized from the nucleus to the cytoplasm and degraded. An increase in cellular glucose uptake will lead to increased production (...) of ROS. This in turn activates the stress‐responsive Jun‐N‐terminal kinase (JNK), which promotes nuclear translocation of FOXO proteins, upregulating some important target genes including stress resistance. Consequently, insulin resistance should result in decreased cellular ROS production. For this reason, insulin resistance could be a physiological mechanism activated at the cellular level in response to conditions stimulating ROS production and leading to the prevention of oxidative stress, and extension of life. This paper aims to provide insights into the Malaysian newspaper reports on apostasy cases in the country. Being a Muslim country with multi-religions, apostasy is highly sensitive hence any issues related to apostasy need to be carefully managed. Four keywords were used to identify newspaper reports for the analysis. Two newspaper reports met the selection criteria and were analysed using a discourse analysis approach focusing on Grammatical Analysis, Macrostructures, and Rhetorical Structures. The analysis reveals that the report in New Straits (...) Times, which is the right-wing newspaper, carries the voice of anti-apostate and disapproves the act of renouncing Islam. On the other hand, the report in The Malay Mail, which is the left-wing newspaper, carries the voice of pro-apostate. By deconstructing the newspaper reports, this paper contributes to the understanding of the agendas that have been subtly set in the news. This paper concludes that the two reports have been strategically constructed to serve the interests and promote the ideology of the two competing groups in the country, thus creating a balance in the multi-religious context. خلصت هذه الدراسة إلى دحض الادعاء بوجود فجوة تاريخية في تطور علم الاقتصاد، حيث تمكن الرواد الأوائل من الاقتصاديين المسلمين من وضع العديد من الأسس الفكرية لعلم الاقتصاد. تسلط هذه الدراسة الضوء على الفترة الزمنية التي تم تجاهلها قصداً أو جهلا لتكشف عن الجذور التاريخية لعلم الاقتصاد الإسلامي وتكشف عن الحلقة المفقودة في تطور علم الاقتصاد منذ القرن الهجري الأول إلى القرن الهجري الخامس، حيث سعت هذه الدراسة إلى نقض ادعاء الريادة الغربية لعلم الاقتصاد من خلال ما عرضته من إسهامات (...) للمفكرين المسلمين الذين سبقوا الاقتصاديين الغربيين بعدة قرون. لقد قام الاقتصاديون المسلمون بتدشين عدد من قواعد علم الاقتصاد، واستخدموا أساليب التحليل الاقتصادي في رصد بعض الظواهر الاقتصادية، وقد قاموا بتسليم إنجازاتهم هذه للبشرية من خلال الصروح العلمية في الأندلس. كذلك لا يزعم مُعدُّ هذه الدراسة أنّ العلماء المسلمين تناولوا جميع القضايا الاقتصادية ولا يدعي بانّهم وضعوا قواعد علم الاقتصاد جملة ولم يغفلوا عن شاردة أو واردة، بل يعترف بأنّ علماء المسلمين الاقتصاديين لم يتناولوا كثيرا من القضايا الاقتصادية المحدثة كالائتمان، والمشتقات المالية، والنقود الالكترونية وما شاكل من المستجدات. لكنه يؤكد إسهام العلماء المسلمين في تطوير الفكر الاقتصادي.
